1. General conditions

Use of this website and the booking of any service offered by Vulcano Ocean Charter, S.L.U. implies full and unconditional acceptance of these terms and conditions. If the user does not agree with any of the conditions set out herein, they must refrain from using this website or making any booking.

The person making the booking acts on their own behalf and on behalf of all participants, accepting these conditions in their entirety.

2. Departure port

Unless duly justified force majeure applies, all departures and arrivals take place from:

Puerto Colón – Pantalán 2 (Costa Adeje, Tenerife)

3. Access to the service

Clients must make their own way to the meeting point and arrive at least 15 minutes before the agreed departure time.

If 30 minutes have elapsed from the scheduled departure time without the client or any of the participants having arrived, the company cannot guarantee that the vessel will wait. In such cases, no refund of any amount paid will be due, unless duly evidenced force majeure applies.

4. Capacity

The maximum capacity of the vessel is 8 passengers, in accordance with the current seaworthiness certificates. Private charter services do not require a minimum number of participants.

5. Duration of service

Trip durations are approximate and may be affected by weather conditions, sea state or other operational factors beyond the company's control.

Vulcano Ocean Charter, S.L.U. will not be liable if the actual duration differs from that originally planned for such reasons, provided the client has been given reasonable notice.

6. Rates, included services and extras

6.1 Services included in the rate

Published prices include the following services:

• Crew (captain and crew member)
• Fuel
• Welcome drink and complimentary snacks
• Port fees
• Civil liability and passenger insurance

6.2 IGIC

Prices include the Canarian General Indirect Tax (IGIC) at the current rate of 7%, in accordance with Law 20/1991 of 7 June on the modification of the fiscal aspects of the Canarian Economic and Fiscal Regime. The tax amount will be itemised on the corresponding invoice.

6.3 Additional services (extras menu)

The company offers clients an optional selection of premium products and services not included in the base rate, payable on board. Details of these extras and their prices will be provided at the time of booking and will be available on board during the service.

Extras are paid in full on board on the day of the service and are not subject to the cancellation policy applicable to the main booking.

7. Booking process and payment

To confirm a booking, the client must pay a deposit of 50% of the total amount through the payment methods provided by the company.

The remaining balance (50%) is due on the day of the service, before boarding, using the payment methods accepted by the company.

The booking will not be considered confirmed until the deposit has been received and confirmed.

8. Right of withdrawal

In accordance with Article 103(l) of Royal Legislative Decree 1/2007 of 16 November approving the revised text of the General Law for the Defence of Consumers and Users (TRLGDCU), the right of withdrawal does not apply to contracts for accommodation services for purposes other than as a residence, transport of goods, car rental, food or services related to leisure activities, where the contracts provide for a specific date or period of performance.

Accordingly, the booking of recreational nautical charter services for a specific date is excluded from the 14-day right of withdrawal applicable to distance contracts. The applicable cancellation policy is set out in clause 9 of these conditions.

9. Cancellation policy

9.1 Cancellation by the client

Cancellation requests must be submitted in writing to the company's email address. The reference date will be the date on which the written request is received. The applicable refunds are as follows:

• Cancellation more than 48 hours before departure: 100% refund of the amount paid.
• Cancellation between 48 and 24 hours before departure: 50% refund of the amount paid.
• Cancellation less than 24 hours before departure or no-show: no refund.

9.2 Cancellation by the company

In the event of cancellation due to force majeure (adverse weather conditions, storm warning, instruction from maritime authorities or other operational causes beyond the company's control), the company will notify the client as soon as possible and offer, at the client's choice:

• A date change at no additional cost (subject to availability), or
• A full refund of the amount paid within a maximum of 14 calendar days from the notification.

The company will not be liable for any additional costs arising from travel, accommodation or other services booked by the client in connection with the cancelled trip.

10. Service modifications

Vulcano Ocean Charter, S.L.U. reserves the right to modify schedules, itineraries or service conditions for operational or weather-related reasons, notifying the client as soon as possible. Where the modification is substantial and the client does not accept it, the client may request cancellation with a full refund in accordance with clause 9.2.

11. Client declaration and liability

By confirming the booking, the client declares that:

• They are of legal age or, if a minor, are acting under the supervision and responsibility of an adult participating in the trip.
• They and all participants are in adequate physical condition for recreational nautical activity.
• The information provided during the booking process is accurate and complete.
• They have informed the other participants of these conditions and that they accept them.

The company will not be liable for:

• Loss or damage to personal belongings on board or in port facilities.
• Injuries or incidents arising from pre-existing medical conditions not disclosed to the company prior to boarding.
• Adverse reactions to seasickness or other conditions related to navigation.

12. Intellectual property

All content on the Vulcano Ocean Charter, S.L.U. website — including texts, images, logos, graphic design and source code — is the property of the company and is protected by applicable intellectual and industrial property law. Reproduction, distribution or public communication without express authorisation is prohibited.

13. Personal data protection

Personal data provided during the booking process will be processed by Vulcano Ocean Charter, S.L.U. as data controller, for the purpose of managing the contracted service and complying with applicable legal obligations.

Processing is carried out under Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) and Organic Law 3/2018 of 5 December on the Protection of Personal Data and guarantee of digital rights (LOPDGDD). 14. Applicable law and jurisdiction

These conditions are governed by Spanish law, including, among other regulations, the revised text of the General Law for the Defence of Consumers and Users (RDL 1/2007), the Maritime Navigation Act (Law 14/2014), and the active tourism regulations of the Autonomous Community of the Canary Islands.

For the resolution of disputes arising from the interpretation or performance of these conditions, the parties submit to the courts of the consumer's place of residence, as provided for under consumer protection regulations, unless applicable law expressly provides for a different jurisdiction.
